MLH AGREEMENT WITH MAINTAINER FOR THE MLH FELLOWSHIP PROGRAM
Major League Hacking PBC Inc. (“MLH”) is operating an educational fellowship program (“Program”) you (“Maintainer”) are subject to the MLH Maintainer Terms for The MLH Fellowship Program. The terms are effective as of the date you accept them ("Effective Date").
A. You as the Maintainer understand that MLH is operating an educational fellowship program (“Program”) and that Maintainer will be assisting MLH in furthering the educational objectives of the Fellows who have enrolled in the Program. The Maintainer agrees to further those educational objectives in the manner set forth below and at all times consistent with the educational focus of the Program. The terms, conditions, and understandings below are intended to make sure you, as the Maintainer, are fully familiar with and follow at all times the expectations of MLH and the Fellows as well as the ground rules for the Program.
B. The Program is a fully-remote 12-week educational program. The Fellows are proficient in at least one programming language and have some experience working on a variety of projects using that language. The Program is designed to provide Fellows with a hands-on, real-life Open Source learning experience focusing on putting into practice what they are learning or have learned at their educational institutions. Fellows are to be introduced to tools and techniques used widely in the software technology field. Fellows will then be encouraged to use and experiment with these tools and techniques in collaborative Open Source projects. The skills that Fellows are to develop during the Program are intended to be useful across the software technology industry.
C. Fellows will be working in a collaborative manner in a group of 8-10 other Fellows that is called a Pod. A Mentor will be assigned to each Pod. Mentors will serve as educational and technical resources. This Fellowship Program is not the same as a job. No Mentor or Maintainer should direct, control, or tell Fellows how to participate in the Program. Fellows, like students, make those types of decisions. The roles of Maintainers like you and Mentors is to provide Fellows with the same type of learning experience that a professor or teaching assistant in a university imparts to their students.
D. The projects that Fellows will be working on during the Program will be real-life projects that have been selected by MLH. Only projects that have potential for providing a meaningful educational experience are selected for a Pod. You or your employer have submitted one or more of the projects that have been selected for one or more Pods of Fellows.
E. To the extent you interact with the Fellows, you understand that you are expected to provide Fellows with the same type of clinical experience they might get in a practicum in a university – technical skills for real-world application that they may eventually utilize when working for any one of thousands of companies using Open Source technologies.
F. It is understood that each Pod’s collaborative contribution might conceivably be used one day by your employer or some other organization. It is understood by the Fellows that, in that event, neither the Fellows nor their Mentor will receive any reward or compensation; that is not the purpose of this Fellowship or the purpose of Open Source.
G. You understand that there are no charges to Fellows admitted to this Program. They will actually receive an educational stipend to cover their costs of future qualified educational expenses, such as tuition, required enrollment, or attendance fees at an educational institution; and/or books, supplies, software, and equipment required for enrollment or coursework at an educational institution.
H. Fellows understand that participating in the Fellowship Program does not guarantee them any job opportunities with you, your employer, with MLH, with any of the Sponsors or Partners, or with any company employing the Mentors, or through your or their connections. This Program is intended to make Fellows in the Fellowship more marketable at many companies that use Open Source software. Fellows are encouraged to distinguish themselves in the manner in which they collaborate and contribute to their Pod; those Fellows may well be afforded greater job opportunities. Major League Hacking may also engage in promotional efforts to benefit Fellows in this Program, especially those who it learns have excelled in this 12-week Program.
I. You agree that in the event you are unable to provide the services of Maintainer for any period you are expected to further the educational interests of the Fellows, you will use your best efforts to provide a capable substitute.
J. You agree to conduct yourself at all times in a lawful manner and to provide the educational services you have agreed to provide consistent with industry or commonly accepted standards applicable to those who conduct real-world educational internships and fellowships.
K. You agree that you are not an agent, employee, partner, or joint venturer with MLH and that neither you or the person who created the project, nor your employer (if applicable) or the employer of the person who created the project (if applicable), expect any compensation from MLH and will receive no compensation from MLH. Your relationship and (if applicable) your employer’s relationship with MLH is as an independent contractor engaged to further the educational objectives of the Program in the manner and consistent with the terms set forth above, and the parties agree not to hold you out as an employee, agent, partner, or joint venture of MLH.
